1 de Maio de 2011 foi a data que a intelligence dos EUA escolheu para ‘matar’, pela nona vez, o seu papão mor, Ossama Bin Laden [#OBL] ou como é conhecido nos cheques que a CIA passa, operacional Tim Osman.

Esta data segundo o muito interessante blog, The Vigilant Citizen, não foi escolhida por acaso, tratou-se de um ritual….à luz do dia, para que todos tomassem parte dele, ainda que não se tenham apercebido disso.

Só passadas umas quantas horas é que tive conhecimento da nova longa metragem made in CIAwood,
sem no entanto ter ainda acesso à grande rede, limitei-me a pensar no
que os senhores do mundo (não os EUA, mas a elite que nos desgoverna)
teriam incumbido o seu fantoche, Obama, de nos vender.

Obama found Osama and had him murdered, apparently unarmed in his underwear, defended not by al Qaeda, “the best trained, most dangerous vicious killers on the planet,” but by two unarmed women.

As I offered previously, if you believe this, I have a bridge in Brooklyn that I can let you have for a cheap price.

Pensei mesmo para os meus botões que iria ser surpreendido (ironia) com dados concretos, verificados por entidades independentes e sem qualquer margem para dúvidas…
Afinal de contas como dizia o saudoso Carl Sagan….“Alegações extraordinárias exigem evidências extraordinárias.”

Mas não! 😉

Segundo Obama e seus acólitos, nós meros cidadãos do mundo, escravos da elite da NWO/Nova (Des)Ordem Mundial, tínhamos de acreditar no que os ‘nossos senhores’ nos estavam a contar, que OBL havia sido morto e o seu corpo deitado ao mar, supostamente com dois objectivos, cumprir a lei/tradição islâmica e não tornar o local onde supostamente fosse enterrado numa romaria….ah e parece que também não conseguiam arranjar no planeta inteiro um pedaço de terra onde o sepultar! Parece que se esqueceram, de não
sei…talvez quem sabe entregar o corpo à família?!!

Nesta nova teoria que segue muito o padrão da dos supostos
19 terroristas equipados com x-actos que conseguem ultrapassar uma
defesa de biliões de dólares, inclusive manter aviões de combate em
terra, só que desta vez em vez de Bush filho temos Obama a fazer as
honras da casa, temos de ter em atenção a perspectiva histórica de tudo
isto, para tal enumerarei no fim da entrada de acordo com cinco pontos
algumas realidades que precisam não ser esquecidas.

No entanto relativamente aos últimos acontecimentos algumas questões se levantam logo;

1ª Segundo a lei/tradição islâmica um corpo nunca deve ser sepultado no mar, excepto se a pessoa lá morre e não consegue ser recuperado o corpo ou se é mesmo impossível transportá-lo para terra.

Nenhum destes casos se verificou.

2ª As Administrações dos EUA não se têm preocupado em cumprir quaisquer
leis, particularmente a islâmica, muito menos de índole religioso, ético
ou até do Direito Internacional, basta ver o que fizeram com Saddam Hussein ou com os prisioneiros e crianças que têm torturado e morto no Iraque e Afeganistão; não esquecendo os ataques com drones um pouco por todo o lado matando milhares de civis, inclusive no Paquistão.

Não é muito credível que de repente se comecem a preocupar.

3ª Como é que os EUA poderiam enterrar o corpo ou entregá-lo à família quando com grande probabilidade não o têm uma vez que OBL terá morrido em finais de Dezembro de 2001 e terá sido enterrado em local incerto, segundo diversas notícias publicadas em jornais do Paquistão, Índia etc?!

Inclusive antes de ser assassinada, Benazir Bhutto afirmou que OBL havia sido morto anos antes.

First, up until mid-December 13, 2001, the CIA had regularly been intercepting messages between bin Laden and his people. At that time, however, the messages suddenly stopped, and the CIA has never again intercepted a message.

Second, on December 26, 2001, a leading Pakistani newspaper published a story reporting that bin Laden had died in mid-December, adding: “A prominent official in the Afghan Taleban movement . . . stated . . . that he had himself attended the funeral of bin Laden and saw his face prior to burial.”

Third, bin Laden had kidney disease. He had been treated for it in the American Hospital in Dubai in July 2001, at which time he reportedly ordered two dialysis machines to take home. If you have ever wondered what bin Laden was doing the night before the 9/11 attacks, CBS News reported that he was being given kidney dialysis treatment in a hospital in Pakistan. And in January of 2001, Dr. Sanjay Gupta said – based on a video of bin Laden that had been made in either late November or early December of 2001 – that
he appeared to be in the last stages of kidney failure.

4ª Tentam-nos fazer acreditar que OBL terá vivido durante anos ao lado de uma academia militar paquistanesa sem que a CIA com fortíssimas ligações aos serviços secretos paquistaneses ISI, soubesse do seu paradeiro até 1 de Maio de 2011.

Hamid Gul, ex-responsável pela intelligence paquistanesa, ISI, chama a tudo isto de “CIA “Choreographing” Osama Assassination Hoax“.

O coronel russo e analista militar, Evgeny Khrushchev, também é da opinião que a história contada por Obama e seus assessores parece um conto de fadas ensaiado.

5ª Querem ainda que acreditemos que ninguém na região sabia que um homem daquela importância vivia lá há anos.
Aliás é interessante de ouvir esta reportagem da BBC no local, onde é dito por alguém dessa região que supostamente lá vive há muitos anos, que quem os EUA supostamente assassinaram foi o seu vizinho Akhbar Khan (alguém sabe o significado deste nome?).

6ª Se de facto se tratava mesmo de OBL supostamente a mente por detrás dos atentados de 11et2001 embora até agora não tenha sido apresentada uma única prova que fosse, inclusive o FBI não possui evidência disso, Dana Perino ex-porta-voz da Casa Branca de Bush confirma que não foi OBL assim como o ex-Vice-Presidente Dick Cheney, não havia nenhuma razão para o assassinar, de facto existiam múltiplas razões para precisamente evitarem a todo o custo a sua morte, afinal de contas se essa pessoa era tão perigosa para os EUA havia que a apanhar viva, interrogá-la e para que todo o mundo soubesse que os EUA são um país onde a Justiça prevalece, deveriam julgar num Tribunal civil essa
pessoa, por forma a que os EUA pudessem apresentar provas da sua culpabilidade e a pessoa ter a hipótese de se defender dessas mesmas
acusações.

Na verdade nunca foi objectivo dos EUA deterem e levarem a Tribunal OBL, o ex-número 3 da CIA terá mesmo afirmado que Bush o ajudou a escapar, isso implicaria virem a público muitas das histórias sobre a cumplicidade dos EUA na criação, treino e suporte financeiro bem como ligações a outros países (Arábia Saudita, Emiratos Árabes Unidos, Paquistão) destes grupos anteriormente designados e protegidos pelos media dos EUA, hoje terroristas para os mesmos media.
A mais recente utilização por parte dos EUA e NATO da base de dados dos guerrilheiros mujahadeen, Al-Qaeda, acontece precisamente na Líbia, mais uma vez os media mainstream chamam-lhes revolucionários….

7ª É sabido que OBLsofria de deficiência renal, necessitando mesmo de fazer diálise.
Até hoje não foi encontrada, ou pelo menos não nos foi dito que tivessem
encontrado uma máquina de diálise no local onde supostamente assassinaram OBL.
Conseguiram supostamente encontrar filmes porno (a ser verdade pergunto-me se não seriam usados para enviar mensagens codificadas/escondidas usando Steganografia) mas não uma máquina de diálise….estranhas prioridades!
É claro que encontrar uma máquina de diálise era chato para a versão oficial, afinal de contas colocaria-a em causa, já para não falar que daria credibilidade às notícias de OBL ter sido tratado no hospital americano do Dubai e de Rawalpindi no Paquistão.

on his current pharmaceutical intake, [we] would expect that he has no more than six to 18 months to live and impending kidney failure.”

Responsáveis norte-americanos confirmaram a descoberta de uma “quantidade considerável” de filmes, salientou o “The New York Times”, que poderiam pertencer ao líder da Al-Qaeda ou a outras pessoas que viviam na casa.
Não é uma descoberta pouco comum neste tipo de situações, sublinhou a Reuters a partir de relatos de três responsáveis norte-americanos que
pediram anonimato mas que acompanharam investigações relacionadas com outros militantes islamistas.

Muitos dos vídeos encontrados foram descarregados da Internet e estavam guardados num cofre no quarto de Bin Laden, adiantou a estação de televisão ABC.

Também é de notar estes interessantes dados que o jornal Público aqui nos deixa, “sublinhou a Reuters a partir de relatos de três responsáveis norte-americanos que pediram anonimato”, “Muitos dos vídeos encontrados foram descarregados da Internet”.
Sinceramente não consigo perceber como o jornal português, o NYTimes e a Reuters dão tanta credibilidade a “responsáveis norte-americanos que pediram anonimato”; caros jornalistas com fontes desse tipo as vossas notícias valem ZERO.

Parece que o ‘jornalismo’ de hoje em dia se limita ao copy/paste e ao disse que disse.

O outro ponto interessante é afirmarem que os supostos vídeos terão sido
descarregados da Internet, presumo que depois expliquem que foram
descarregados noutro lado que não o complexo onde supostamente OBL terá
sido assassinado, a não ser que mais uma vez a história que nos têm
vindo a contar tenha novamente mudado, o que convenhamos se está a
tornar um hábito.

8ª A história à volta desta novela de baixo orçamento está constantemente a mudar.

Primeiro OBL estava armado e escondeu-se atrás de uma das suas mulheres, depois já não estava armado nem se escondeu atrás dela, depois uma das mulheres já não havia sido assassinada como primeiro afirmaram.

Primeiro afirmaram que houve batalha durante cerca de 40 minutos, por fim já
afirmam que os SEAL só mataram um homem quando aterraram no local e que
não dispararam mais durante o resto da operação….o que leva à questão,
se não dispararam mais, o suposto OBL não terá sido assassinado no
local.

Agora parece que após o representante das Nações Unidas para os direitos humanos ter questionado a legalidade de semelhante operação, a Administração Obama resolveu deixar de tentar criar mais cenários.

9ª Leon Panneta o número um da CIA, afirmou que durante vinte cinco minutos
enquanto decorria a operação não existiu qualquer transmissão de imagens ou audio do que se passava no local da operação, o que levanta suspeitas sobre a famosa foto do staff da Casa Branca todo reunido à volta de….provavelmente um ecrã negro, ou quem sabe algumas filmagens da Sala Oval com Bill Clinton e a senhorita Monica pelo menos tendo em conta a expressão da sra Clinton 😉

Ah…já agora, parece que segundo a Casa Branca, a história da fotografia também já não é bem como a contaram num primeiro momento….

Osama bin Laden dead: Blackout during raid on bin Laden compound – Telegraph

Leon Panetta, director of the CIA, revealed there was a 25 minute blackout during which the live feed from cameras mounted on the helmets of the US special forces was cut off.

A photograph released by the White House appeared to show President
Barack Obama and his aides in the situation room watching the action as
it unfolded. In fact they had little knowledge of what was happening in the compound.

10ª E o que dizer da famosa fotografia em que supostamente aparecia OBL morto que os media ajudaram a propagandear mas que passada menos de uma hora já se sabia que era falsa…tendo no entanto enganado até três senadores.

No entanto para levar a cabo uma PSY-OP deste género o que conta são os primeiros minutos, as primeiras imagens como aliás mais uma vez se viu no caso dos atentados do WTC em 11Set2001 onde por certo um operacional deu o mote para a história da queda dos edificios ser devida ao embate dos aviões….até porque ainda hoje muita gente nem sabe que caiu um terceiro arranha-céus, o WTC7, sem que qualquer avião tivesse embatido neste.

Esses primeiros minutos são cruciais para levar o povão a acreditar na fantasia oficial que lhe estão a vender.

11ª Os valores apresentados pela Administração Obama para a casa onde
supostamente habitava OBL estão longe de ser o tal $US 1M de dólares,
segundo diversos especialistas que conhecem bem o mercado habitacional
daquela área, a vivenda onde tudo decorreu, que de luxuosa muito pouco tinha, vale cerca de $US 250,000 dólares.

12ª Foi-nos dito que uma das razões para o suposto OBL se ter mantido
incógnito durante anos naquela casa terá sido em virtude de não existirem meios de comunicação electrónicos como por exemplo acesso à rede Internet.
No entanto mais tarde as sempre anónimas fontes dizem-nos que foram encontrados telemóveis.

Cada dia que nasce, nasce com ele uma nova história.
E os media mainstream, especialmente os nossos, papam-nas todas sem um mínimo de esforço para as questionar.

Como querem estes mentirosos/criminosos compulsivos que acreditemos em mais uma história que nem sequer seria verosimel num filme de baixo
orçamento, quando nos vêm mentido descaradamente amiúde, como se pode
facilmente comprovar com a história das armas de destruição massiva da
segunda invasão do Iraque, em que como já reconheceu, Collin Powell deliberadamente mentiu perante a Assembleia das Nações Unidas?! Ou como o demonstram no caso inglês, os Memos de Downing Street.

Como querem que acreditemos em mais esta farsa, quando na primeira invasão
do Iraque, quando haviam dado permissão ao Iraque para atacar o Kuwait,
vieram a público com a vil mentira de que os iraquianos estavam a matar
crianças em incubadoras?! Nada disso sucedeu como hoje se sabe, o que
sucedeu é que os EUA e os senhores do Kuwait, pegaram na filha do embaixador Kuwaitiano, Nayirah al-Ṣabaḥ
e colocaram-na frente às câmaras a fazer a actuação da sua vida, digna
de óscar, mentindo descaradamente sobre algo que nunca se passou, a tal
história dos bebés e das incubadoras.

Mais, como quer a Administração Obama ou outra, fazer-nos acreditar em mais esta história mirabolante quando nos mentiram
repetidamente sobre a história da soldado Jessica Lynch, do jogador de
futebol americano Pat Tillman e da britânica Linda Norgrove?

Despite the initial suggestion that he died “in the line of devastating enemy fire”, he was killed by his own side. His family was not told the truth about how he died until five weeks after his memorial service was broadcast on national TV.

In a biography published two years ago, it was claimed Tillman regarded his president as a cowboy who had led the country into an illegal and unjust war in Iraq. Tillman had noted in his diary his suspicion that the rescue of Jessica Lynch was “a media blitz”.

Until the killing of the al-Qaida chief, the most recent inaccurate account of a high-profile incident came last October, with the botched mission to free the kidnapped British aid
worker Linda Norgrove.

Members of Seal Team 6 – the special forces unit that killed Bin Laden – were sent to rescue Norgrove from eastern Afghanistan but one of them accidentally killed her by throwing a fragmentation grenade close to where she was sheltering.

13ª Um especialista em DNA de Forth Worth, Bruce Budowle (DNA expert and professor in the University of North Texas Health Health Science Center’s Department of Forensic and Investigative Genetics and executive director of the Institute of Investigative Genetics), afirma que não foram divulgados pelos EUA quaisquer dados relativos às supostas análises ao DNA de OBL e que os dados apresentados pelos media não são verdadeiros.

Existem ainda diversas questões e problemas relativos a este tipo de identificação.

Segundo o mesmo especialista 99,99% de certeza só é possível com DNA da própria pessoa (sangue ou saliva), ou seja a Administração dos EUA teria de
possuir uma amostra de DNA de OBL para agora comparar, algo muito
provável tendo ele sido um operacional da CIA, ou então recorrendo ao
maior número possível de familiares, algo bem mais complexo uma vez que
não creio que os familiares estejam dispostos a tal, ainda por cima para
aumentarem as probabilidades de confirmação necessitam ser familiares o
mais chegados possível, tipo irmãos etc.

De qualquer forma do ponto de vista de apresentar ao mundo provas
concretas e independentes, mesmo recorrendo a supostas análises de DNA, a
única maneira de o fazer é tendo o corpo, no entanto a primeira coisa
que fizeram foi verem-se livres dele.
Como tal é impossível verificar de forma independente os dados que a Administração Obama venha a apresentar.

Aliás, por essa razão o filho de OBL, Omar, afirmou que “We are not convinced on the available evidence in the absence of [a] dead body,”

Omar Bin Laden foi ainda mais longe questionando a razão pela qual o seu pai
supostamente terá sido assassinado, ainda para mais quando estava desarmado, tendo os EUA violado os mais básicos principios e leis
internacionais, usando força não justificada.
Tendo supostamente OBL cometido crimes em diversos países este deveria ter
sido detido e presente a um Tribunal Internacional para ser julgado.
Escusado será dizer que isso os EUA nunca poderiam permitir, uma vez que se
viria a conhecer muita informação que as Administrações de Carter a Obama querem é esconder, fazer desaparecer para sempre.

Recomendo a leitura do artigo do Bruno Fehr, onde ele foca alguma destas questões, especialmente as muitas dúvidas colocadas pelos media mainstream da Alemanha.

14ª E dando continuidade ao patrocínio e treino de supostos grupos
terroristas que na realidade não passam de ferramentas da elite que nos
controla, a Administração Obama prepara-se para substituir o seu antigo

Amsterdam, Cees Wiebes, documents in Intelligence and the War in Bosnia 1992-1995, how Western intelligence agencies, including the CIA, MI6 and BND assisted major arms transshipments into Bosnia despite a UN arms embargo, often in concert with the reactionary Iranian regime.

Some estimates claim that by 1994, as many as 4,000 mujahedin fighters were present in Bosnia. Indeed, none other than Osama bin Laden himself visited Izetbegovic in Sarajevo. As a gesture of appreciation for his support, Izetbegovic gave bin Laden a Bosnian passport. And, a November 1, 2001 account in the European edition of The Wall Street Journal claimed that bin Laden continued to visit the Balkan region as late as 1996.

By 1995 as Wiebes documented, American Hercules C-130 transport planes accompanied by jet fighters began landing at the Tuzla Air Base in eastern Bosnia laden with arms, ammunition and communications equipment destined for Izetbegovic’s Islamist brigades. Similar arms pipelines were opened between Albania, Bosnia, Croatia and later in the decade Kosovo, where Albanian narcotrafficking networks rule the roost and continue to wreck havoc across the region.

When asked why there is no mention of 9/11 on Bin Laden’s Most Wanted web page, Tomb said, “The reason why 9/11 is not mentioned on Usama Bin Laden’s Most Wanted page is because the FBI has no hard evidence connecting Bin Laden to 9/11.”

Surprised by the ease in which this FBI spokesman made such an astonishing
statement, I asked, “How this was possible?” Tomb continued, “Bin Laden has not been formally charged in connection to 9/11.” I asked, “How does that work?” Tomb continued, “The FBI gathers evidence. Once evidence is gathered, it is turned over to the Department of Justice. The Department of Justice than decides whether it has enough evidence to present to a federal grand jury. In the case of the 1998 United States Embassies being bombed, Bin Laden has been formally indicted and charged by a grand jury. He has not been
formally indicted and charged in connection with 9/11 because the FBI has no hard evidence connected Bin Laden to 9/11.”

The idea that Osama bin Laden was responsible for the 9/11 attacks has been an article of faith for public officials and the mainstream media. Calling it an “article of faith” points to two features of this idea. On the one hand, no one in these circles publicly challenges this idea.

On the other hand, as I pointed out at length in two of my books – 9/11 Contradictions1 and The New Pearl Harbor Revisited,2 no good evidence has ever been publicly presented to support it.

Colin Powell’s Withdrawn Promise Two weeks after 9/11, Secretary of State Colin Powell, speaking to Tim Russert on Meet the Press, said that he expected “in the near future . . . to put out . . . a document that will describe quite clearly the evidence that we have linking [bin Laden] to this attack.”

Powell reversed himself, however, at a press conference with President Bush in the White House Rose Garden the next morning, saying that, although the government had information that left no question of bin Laden’s responsibility, “most of it is classified.”4 According to Seymour Hersh, citing officials from both the CIA and the Department of Justice, the real reason for
the reversal was a “lack of solid information.”

This was the week that Bush, after demanding that the Taliban turn over bin Laden, refused their request for evidence that bin Laden had been behind the attacks.6 A senior Taliban official, after the US attack on Afghanistan had begun, said: “We have asked for proof of Osama’s involvement, but they have refused. Why?”7 Hersh’s answer was that they had no proof.

Blair’s report, however, began by saying: “This document does not purport to provide a prosecutable case against Osama Bin Laden in a court of law.” Although the case was not good enough to go to court, Blair seemed to be saying, it was good enough to go to war.

Escusado será dizer que o assassinato de OBL, caso tenha realmente acontecido (o que duvido como acima tentei explicar), será por certo ilegal à luz quer do Direito nos EUA quer do Direito internacional, ainda para mais quando hoje se sabe que o suposto OBL não ofereceu resistência que colocasse em perigo a vida dos SEAL uma vez que estava desarmado.

Mas mesmo que a história do seu assassinato seja uma fantasia, a verdade é
que tropas dos EUA levaram a cabo uma operação militar dentro de um país
soberano, Paquistão, sem que este tivesse sido informado, por certo será ilegal.

Eis alguns artigos recomendados sobre esta temática, recomendo especialmente o do jornal Spiegel o de Glen Greenwald do site Salon em que este escreve sobre a autorização dada por Obama, Extrajudicial killing, que permite o assassinato inclusive de cidadãos dos EUA sem que estes sejam previamente julgados num Tribunal civil ou mesmo militar.

Ainda que eu não seja propriamente grande adepto de Noam Chomsky que considero um gatekeeper, este tem sem dúvida um artigo sobre o tema que merece ser lido.

Outro artigo interessante também de Glen Greewald, traz-nos o Julgamento de Nuremberga e os crimes de guerra comparando com o que se vai passando com as diversas operações militares dos EUA.

Como já escrevi, desde a WWII que os EUA não declaram qualquer guerra,
chamam-lhes operações exactamente porque o Presidente não tem o poder de
declarar guerra, apenas o Congresso, o que nunca mais sucedeu desde a
II Guerra Mundial, apesar dos EUA estarem envolvidos em guerras
ininterruptamente desde essa altura.

It’s increasingly clear that the operation was a planned assassination, multiply violating elementary norms of international law. There appears to have been no attempt to apprehend the unarmed victim, as presumably could have been done by 80 commandos facing virtually no
opposition—except, they claim, from his wife, who lunged towards them. In societies that profess some respect for law, suspects are apprehended and brought to fair trial. I
stress “suspects.” In April 2002, the head of the FBI, Robert Mueller, informed the press that after the most intensive investigation in history, the FBI could say no more than that it “believed” that the plot was hatched in Afghanistan, though implemented in the UAE and Germany. What
they only believed in April 2002, they obviously didn’t know 8 months earlier, when Washington dismissed tentative offers by the Taliban (how serious, we do not know, because they were instantly dismissed) to extradite bin Laden if they were presented with evidence—which, as we soon learned, Washington didn’t have. Thus Obama was simply lying when he said, in his White House statement, that “we quickly learned that the 9/11 attacks were carried out by al Qaeda.”

We might ask ourselves how we would be reacting if Iraqi commandos landed at George W. Bush’s compound, assassinated him, and dumped his body in the Atlantic. Uncontroversially, his crimes vastly exceed bin Laden’s, and he is not a “suspect” but uncontroversially the “decider” who gave the orders to commit the “supreme international crime differing only from other war crimes in that it contains within itself the accumulated evil of the whole” (quoting the Nuremberg Tribunal) for which Nazi criminals were hanged: the hundreds of thousands of deaths, millions of refugees, destruction of much of the country, the bitter sectarian conflict that has now spread to the rest of the region.

Same with the name, Operation Geronimo. The imperial mentality is so profound, throughout western society, that no one can perceive that they are glorifying bin Laden by identifying him with courageous resistance against genocidal invaders. It’s
like naming our murder weapons after victims of our crimes: Apache, Tomahawk… It’s as if the Luftwaffe were to call its fighter planes “Jew” and “Gypsy.”

In late January, I wrote about the Obama administration’s “presidential assassination program,” whereby American
citizens are targeted for killings far away from any battlefield, based exclusively on unchecked accusations by the Executive Branch that they’re involved in Terrorism. At the time, The Washington Post’s Dana Priest had noted deep in a long article that Obama had continued Bush’s policy (which Bush never actually implemented) of having the Joint Chiefs of Staff compile “hit lists” of Americans,
and Priest suggested that the American-born Islamic cleric Anwar
al-Awlaki was on that list. The following week, Obama’s Director of
National Intelligence, Adm.
Dennis Blair, acknowledged in Congressional testimony that the administration reserves the “right” to carry out such assassinations.

Benjamin Ferencz is a 92-year-old naturalized U.S. citizen, American combat soldier during World War II, and a prosecutor at the Nuremberg Trials, where he prosecuted numerous Nazi war criminals, including some responsible for the deaths of upward of 100,000 innocent people. He gave a fascinating (and shockingly articulate) 13-minute interview yesterday to the CBC in Canada about the bin Laden killing, the Nuremberg principles, and the U.S. role in the world.

All of Ferencz’s answers are thought-provoking — including his discussion of how the Nuremberg Principles apply to bin Laden — but there’s one answer he gave which I particularly want to highlight; it was in response to this question: “so what should we have learned from Nuremberg that we still haven’t learned”?  His answer (audio):

I’m afraid most of the lessons of Nuremberg have passed, unfortunately.  The world has accepted them, but the U.S. seems reluctant to do so.
The principal lesson we learned from Nuremberg is that a war of aggression — that means, a war in violation of international law, in violation of the UN charter, and not in self-defense — is the supreme international crime, because all the other crimes happen in war.  And every
leader who is responsible for planning and perpetrating that crime should be held to account in a court of law, and the law applies equally to everyone.

These lessons were hailed throughout the world — I hailed them, I was involved in them — and it saddens me to no end when Americans are asked:  why don’t you support the Nuremberg principles on aggression?  And the response
is:  Nuremberg?  That was then, this is now.  Forget it.

Is this what justice looks like? Al-Qaida boss Osama bin Laden was killed on Sunday in a secret military operation in Pakistan. Americans are celebrating, but there are serious doubts about whether the targeted killing was legal under international law and the laws of war.

Claus Kress, an international law professor at the University of Cologne, argues that achieving retributive justice for crimes, difficult as that may be, is “not achieved through summary executions, but through a punishment that is meted out at the end of a trial.” Kress says the normal way of handling a man who is sought globally for
commissioning murder would be to arrest him, put him on trial and ultimately convict him.
In the context of international law, military force can be used in the
arrest of a suspect, and this may entail gun fire or situations of
self-defense that, in the end, leave no other possibility than to kill a
highly dangerous and highly suspicious person. These developments can also lead to tragic and inevitable escalations of the justice process.

In truth, it isn’t quite that simple. And not everything that the United States declares to be war really is. Legal experts like Kress say it is “questionable whether the USA can still claim to be engaged in an armed conflict with al-Qaida.”

And what business did the United States even have acting within the territory of Pakistan, a foreign power? A military strike that crosses national borders, barring acts of self-defense, is generally viewed as an infringement on sovereignty — unless Pakistan’s government requestedhelp from the Americans.
